NSW Government launches the Environmental Planning & Assessment (Development Certification and Fire Safety) Regulation 2021

The NSW Department of Planning has undertaken a review of the Environmental Planning and Assessment Regulation 2000, in an attempt to simplify and speed up the planning process.

On the completion of the review, provision was made for building regulation and certification to be moved into the Environmental Planning & Assessment (Development Certification and Fire Safety) Regulation 2021.

This new Regulation contains the provisions of Part 6 of the Environmental Planning and Assessment Act 1979 which covers building and subdivision certification, as well as the requirements for building essential fire safety measures lifecycle maintenance.

The changes will allow for a more simplified and streamlined procedural understanding of the requirements to achieve compliance. The new Regulation identifies the required services, documentation and professionals required to be engaged to ensure planning, construction and project completion is achieved without confusion and delay.

From the building owner’s viewpoint, these changes will make no material difference to the existing Annual Fire Safety Statement process that has been in place since 2017.
